Despite the successes recorded by the Nigerian troops in recent times, a crop of black sheep -two soldiers of the Explosive Ordinance Device personnel attached to 143 Battalion, identified as Eric Nwokorie and Macauley Fortune were arrested last Sunday 7th February 2016, at Yola park with some unauthorized military items.

The items are; 1 Smoke grenade, 2,136 live rounds of 7.62 (Special) ammunition, 50 live rounds of 7.6mm (NATO) ammunition, 5 magazines of AK 47 rifles, 2 Browning Machine Gun live rounds of ammunitions. Others include, 1 Axe, 1 Cutlass, 1 Jack knife, 9 Jungle hats, 11 pairs of Camouflage (9 Desert and 3 woodland green), 4 Military Pullovers, 1 Black beret, 1 Green beret, 1 Pair of number 7 dress, 2 General Duty belt, 12 Army T-shirts, 2 Rain Coats, 2 Water bottles, 1 Pairs of Rain boot and 5 Pairs of Desert boots.



National Assembly Members Postpone Budget Passing Indefinitely

Members of the National Assembly have suspended the passage of the 2016 budget indefinitely following the discrepancies in figures that has trailed the budget. NASS members had fixed February 25th as the date for the passage of the budget but have shelved it.

This new development was made known‎ at a joint press conference chaired by Sen. Danjuma Goje, Chairman of the Senate Committee on Appropriation and Abdulmumin Jibrin, Chairman House of Representatives Committee on Appropriation in Abuja today February 9th.

“We need sufficient time to pass a comprehensive budget that is implementable and also acceptable,” Jibrin said.

Court Rejects Nnamdi Kanu’s Request For His Seized Passports And Money

A Federal High Court in Abuja on Tuesday dismissed an application by leader of the Indigenous People of Biafra and founder of Radio Biaf‎ra, Nnamdi Kanu, for the release of certain items, including his British and Nigeria passports, which are in the custody of the Department of State Service.

Justice James Tsoho dismissed the application made orally by Kanu’s lawyer, Mr. Chuks Muouma (SAN), who had sought the release of the items because they would not be needed by the prosecution since they were not listed as part of exhibits to be tendered.

Apart from the passports, other items which Muouma sought to be released to the IPOB leader who is currently in detention at Kuje prison along with his two co-accuse, are cash sums of $2,200 and N87,000.Justice Tsoho, in dismissing the application for lacking in merit, insisted that the fact that the items were not listed as possible exhibits did not foreclose the possibility of their being later used by the prosecution as exhibits.

‎He then adjourned the case till February 19 for the hearing of an application by the prosecution for protection of its witnesses.

The judge, before adjourning the case, granted the request by the defence lawyer to the effect that relations of the accused persons be allowed in the court room subject to security screening and the capacity of the court room.

Kanu, David Nwawusi and Benjamin Madubugwu are being prosecuted on six counts of treasonable felony, unlawful possession of firearms and other offences bordering on their agitation for secession ‎of the Republic of Biafra from Nigeria.

‎Justice Tsoho had on January 29 denied bail to Kanu and the two other defendants and ordered that they remained on remand pending the period of their trial.

The judge in rejecting the accused persons’ bail application, held that they were not entitled to bail as they failed to challenge the allegation by the prosecution that they would continue to commit the alleged crime for which they were being prosecuted if granted bail.

Kanu was in the custody of the Department of State Service from the time of his arrest in a Lagos hotel on October 14, 2015 till January 20, 2016, when he was transferred to prison by an order of Justice Tsoho , shortly after he was arraigned along with two others.

Recruiter Of Terrorists For ISIS, Others, Arrested In Nigeria

The State Security Service on Tuesday announced the arrest of one Abdussalam Enesi Yunusa alleged to a recruiter for the Islamic State of Iraq and Syria (ISIS).
In a statement made available to PREMIUM TIMES, the SSS through a statement by one of its officials, Tony Okpuiyo, said Mr. Yunusa was arrested in Kano on January 17 after he “completed arrangements to embark on a journey to join an ISIS terrorist training camp in Libya, with other Nigerians whom he recruited for the ISIS.”

… Planned Terrorists Attacks in States Aborted
In line with the Service statutory mandate to decisively and continually provide actionable intelligence as well as act to degrade persons and groups that threaten internal security in the Country, the Service initiated series of tactical operations, involving raids and enforcement actions against identified criminal and extremist kingpins and syndicates across the country.
These recent operations have significantly degraded the key extremist groups and kidnapping gangs, terrorizing innocent citizens in the Country, particularly in the South-West, North-West and Middle-Belt regions of the Federation.

On 17th January, 2016, one Abdussalam Enesi YUNUSA, a recruiter for the Islamic State of Iraq and Syria (ISIS) was arrested in Kano. His arrest was sequel to available intelligence which indicated his terrorist antecedents and covert drive to indoctrinate and recruit susceptible youths in the country.
Prior to his arrest, YUNUSA had completed arrangements to embark on a journey to join an ISIS terrorist training camp in Libya, with other Nigerians whom he recruited for the ‘Islamic State’. These recruits include the trio of one Muhammed RABI’U, Yahaya Momoh JIMOH and Zainab SUNDAY (f). YUNUSA is a 400 level undergraduate student of the Federal University of Technology, Minna, Niger State, where he was studying for a degree in Information and Media Technology.
He was subsequently radicalized and became a member of an extremist cell, comprising of one IBRAHIM (fnu) and Abubakar LIGALI, whom he revealed are currently undergoing terrorist training in Libya. He listed one AMINU (fnu) and Ibrahim JIHADI (Nigeriene), as other ISIS agents operating in Nigeria and the West African sub-region. The cell was being funded by one Abu-sa’ad Al Sudani, a media expert with the extremist group using Western Union money transfers to fund the terrorist cell agenda.
On 17th January, 2016, in Daura township of Daura LGA, Katsina State, another budding extremist cell affiliated to ISIS, was intercepted by the Service. One Ibrahim Mohammed DAURA, Zaharadeen SALISU and five other elements of the proscribed extremist group, Ansaru, were arrested by the Service. This group was discovered in an active stage, as its members were already co-ordinating themselves for attacks in Katsina and Kano States.
In the same vein, on 22nd January, 2016, one Obansa SALAMI, Ejide TIJANI aka Abu Uwaise II, Mohammed RABIU aka Ubida II, Zainab MOHAMMED and Abdulqadir Salisu AHMAD were arrested in Kano by this Service, while migrating to Libya, with their immediate families including infants, in a bid to join ISIS. This group was apprehended after painstaking monitoring of its network and plans.
On 29th January, 2016, the Service arrested Mohammed Aliyu NDAKO in Kwara State. NDAKO is a seventeen (17) year old undergraduate student of a tertiary institution in the State. He was arrested sequel to credible intelligence on his plans with one Abdulkadir Salisu AHMAD a.k.a Daddy Tall, another student in Kano State, to carry out coordinated lone-wolf attacks on selected populated targets in Nigeria preferably worship centres or recreation venues. Suspect had hitherto been communicating with foreign extremist elements, while sourcing online terrorist training and support.
Within the window of these tactical operations, between the month of December 2015 and February 2016, the Service, busted the network of syndicated kidnap gangs spanning different regions in the country, especially Kebbi, Zamfara, Niger, Nasarawa, FCT, Oyo and Osun States. Foremost in this line, was the arrest of a gang of five (5) kidnappers, Abubakar HASSAN, Usman MUSA, Usman ADAMU and Idrisa Babangida AHMADU at Ife junction, Osun State, on 3rd February, 2016.
On 5th February, 2016, the fifth member of the gang, Saidu ISYAKU was arrested at Ojo area, Oyo State. These kidnappers, Six (6) AK 47 rifles, five (5) magazines and about one thousand rounds of ammunition were recovered. This gang has been active in the South West axis of the country and were at advanced stages of kidnapping high value targets for huge ransom, before they were intercepted.
Another breakthrough in the fight against kidnapping was the killing of Abubakar MOHAMMED (aka BUBA), and an unidentified member of his group, on 8th February, 2016 close to Jebba Medical Centre, Jebba, Kwara State by security operatives as they tried to escape during a shootout with security operatives. MOHAMMED was a notorious kidnap kingpin known for his brutality and various acts of lawlessness. It is disheartening that this criminal and his men had terrorized, to no end, residents of the South West zone. He was also linked to the kidnap of the elder statesman, Chief Olu Falae, in Ondo State.
In the wake of deliberate vandalism of oil pipelines by criminal elements in the South-South region, the Service arrested one Nengi Samuel IKIBA aka Kockman Abula, a notorious pipeline vandal on 27th January, 2016, in Bayelsa State. IKIBA confessed to vandalizing several pipelines in the State, including the 24” Agoda/Brass Oil pipeline at Idema community in Ogbia LGA of Bayelsa State.
The modest success of the Service in its support to the Federal Government to achieve its desired economic objectives and stability may also be noted. To this effect, the DSS have arrested a group of fraudsters who had concluded plans to hack the Government Integrated Financial Management Information System (GIFMIS) domiciled in the Office of the Accountant General of the Federation in order to steal Four Billion, Five Hundred Million Naira (N4.5b) from the Treasury Single Account (TSA).
The gang was led by one Sunny OKOH, a hacker who worked in collaboration with the trio of Uwem Udo EKPO, a Chief Program Analyst in the OAGF, Maxwell EKENE, a retired security operative and Dozie EGWU, based in Malaysia and who is now at large. The suspected fraudsters intended to use a software they had sourced and codes released to them by EKPO to hack Government accounts in the Central Bank of Nigeria (CBN) and defraud the Government of this huge sum.

It is instructive to note that a credibility problem would have arisen over the TSA policy if these hackers had succeeded in their plan and thus lend credence to the critics of the policy that it ought not to have been introduced and implemented. For the avoidance of doubt, the suspects have been handed over to the EFCC for further investigations and prosecution.

It is pertinent to state that these successes were recorded as a result of proactive and credible intelligence offered by members of the public, sister security agencies and other stakeholders. This Service wish to state that it will continue to deploy every means necessary within its statutory mandate, and armbit of the law to ensure the security and safety of all law-abiding residents and citizens wherever they reside.
It is also germane to urge all and sundry to be extra-vigilant, as well as report any suspicious persons/groups or activities to relevant security agencies, for the sustenance of relative peace in the country.

Delta Governor, Okowa Budgets 25 Billion Naira To Maintain State House - Punch

Governors are to spend billions of naira on foodstuffs, vehicles, entertainment, maintenance and others in the 2016 fiscal year, Saturday PUNCH investigation has revealed.

The information is contained in the 2016 budget proposals as presented by many of the state governors.

Deliberations on the proposals are ongoing at the various state Houses of Assembly but some of the copies of the proposed budgets exclusively obtained by our correspondents showed that the governments had budgeted billions of naira for feeding, travels, vehicles, maintenance, allowances and others.



For instance, Governor Ben Ayade of Cross River State had presented the 2016 budget proposal of N350bn to the state House of Assembly.

A copy of the proposed budget obtained by Saturday PUNCH showed that the government budgeted [b]N13.9bn as overhead cost for the office of the Chief of Staff to the Governor.

A breakdown of the overhead cost showed that N1.4bn was proposed for entertainment and hospitality in 2016 for the governor under the office of the Chief of Staff.

A further breakdown under the sub-head showed that entertainment at meetings would gulp N500m while financial assistance was put at N900m.[/b]

Under travel and transportation, a total of N844m has been budgeted with local travel and transport gulping N832m while foreign trips were put at N12m.

The governor’s office is expected to spend N560m on maintenance repairs and services with plant and generator gulping N100m.

In the aspect of other services, the governor’s security vote was pegged at N4bn, while contingency and press/public relations were proposed to gulp N2.1bn and N610m respectively.

For the office of the deputy governor, overhead cost was put at N225m.

In Delta State, findings showed that the administration of Governor Ifeanyi Okowa budgeted N25bn for the running of the Government House.
Meanwhile, the government has been criticised by some residents over some of its appointments and its pace, which has been described as slow.

Special Adviser to the Governor on Labour Matters, Mr. Mike Okeme, said the N25bn budgeted for the Government House would take care of “repairs, maintenance, logistics, and others.”

Sources said the governor would not likely execute any project because of cash crunch.

A source said, “The man will not execute any project rather; he will keep receiving visitors on courtesy calls as nothing is going on in the state.”

The Plateau State budgeted N8.98bn for the administration of the Government House.

Apart from that, there are some projects the state governor, Mr. Simon Lalong, plans to execute this year, which include the completion of a new Government House, renovation and expansion of the state House of Assembly complex and the renovation and furnishing of the state secretariat.

The Special Adviser to the State Governor on Media, Mr. Mark Longyen, identified other projects to be executed under the budget to include the building and furnishing of a protocol lounge at the Yakubu Gowon Airport, Heipang.

The appropriation bill submitted to the Akwa Ibom State House of Assembly by the state governor apportioned N66.86bn to administration, N9.89bn to education and N7.419bn to health.

Information about the amount budgeted for the State House, governor’s aides and others could not be ascertained as of the time of filing this report.

The Commissioner for Information and Communications, Akwa Ibom State, Mr. Aniekan Umana, said, “We need to look at the budget when the House finishes deliberation on it. As of now, we do not have a budget, what we have now is a proposal; until the House of Assembly passes it into law and the governor gives his assent to it; it is only then we can look at International Statement of Accounting Standard, which breaks down everything.

The Chairman, House Committee on Appropriation and Finance, Mr. Usoro Akpanuso, said work was not yet concluded on the appropriation bill.

The Commissioner for Finance, Mr. Akan Okon, promised to get back to our correspondent as he said he was on board a flight to Abuja.

Meanwhile, the Edo State Chapter of the Peoples Democratic Party has described the state’s 2016 budget as a budget of misappropriation, saying that the state governor, Mr. Adams Oshiomhole, appropriated N10.65bn, representing 9.6 per cent of the total budget to his office.

The party said Oshiomhole’s administration, however, allocated N35m of the N111.50bn budget to the office of his deputy.

The party also accused the state government of neglecting the provision of water to the majority of the citizens of the state by voting a “paltry” N100m for the sector; N300m for agriculture; N5bn for security and N400m for Information and Communications Technology.

Edo State Chairman of the party, Chief Dan Orbih, who recently spoke to journalists in Benin while analysing the state’s 2016 budget, also accused the governor of voting the sum of N3.5bn to the construction of the Accident and Emergency Ward unit at the Benin Central Hospital.

He, therefore, described the hospital ward project as a conduit that would be used to siphon the resources of the state. Funds were also allocated to the ward in the previous two budgets.

But the Special Adviser on Media to Governor Oshiomhole, Prince Kassim Afegbua, said that the budget was only a proposal and “until it becomes a law, it cannot be commented upon.”

The Ogun State Governor, Senator Ibikunle Amosun, recently signed the 2016 Appropriation Bill into law following its passage by the state House of Assembly.

The N200.3bn appropriation bill allocated N89.91bn for recurrent expenditure, N11bn for consolidated revenue fund charges including pensions and gratuities, while N99.291bn was earmarked for capital expenditure.

Efforts by our correspondent to get the sectoral analysis of the budget at the Ministry of Budget and Planning were unsuccessful.

A government source, who spoke on condition of anonymity, said the ministry had yet to do the breakdown.

The source said, “We have yet to do the sectoral analysis of the budget. It is difficult to tell you which sector has what budget for now.”

However, the Kaduna State Governor, Mallam Nasir El-Rufai, described the state’s N171.7bn budget as that of “Sacrifice, Restoration and Change.”

El-Rufal said his administration was able to reduce the 2016 recurrent expenditure by 50 per cent when compared to that of 2014.

He said Government House expenses for 2016 are projected at N563.7m, a 70 per cent cut from the N2.1bn that the previous government spent in 2014,
“the same year that they appropriated only N300m to Ministry of Health for capital projects.”

The governor had said that the 2016 revenue and expenditure estimates comprise N109.3bn (64 per cent) capital and N62.4 (36 per cent) recurrent components, based on a conservative benchmark crude oil price of about $39.50 per barrel.

El-Rufai said, “The budget proposals restore the minimum of 60:40 ratios in favour of capital expenditure. This is in keeping with our agenda to expand access to education, health care, jobs and security.”
A non-governmental organisation, Policy Alert, has urged the Akwa Ibom State Government to be transparent in its budget formulation and implementation.

Its Executive Director, Mr. Larry Ineme, said an appropriation bill should be an open document and that the legislature should invite members of the public for inputs.

Ineme, who was represented by his assistant, Mr. Tijah Akpan, said in Uyo on Friday that citizens should be able to walk into any budget office and obtain a copy of the document for a cover price.

Commenting on the governors’ budgets, a labour consultant and lawyer, Mr. Femi Aborisade, said it was frightening that the state chief executive officers could budget huge billions of Naira for items that had no positive impact on the lives of the people who elected them.

Aborisade said such items like refreshment, food and sitting allowance, among others, should be ignored now because the nation’s economy could not support them.

He said, “Budgeting for refreshments, food, sitting allowances is not limited to governors. The governors are merely following the bad example set by the Presidency. In a period of economic stress where the bulk of the budgets are to be borrowed, budgeting huge amounts for items that are not necessary reflects the insensitivity and callousness of the ruling class.

“There should be mass peaceful protests against budgeting for refreshments where the national minimum wage is not being paid and several thousands of workers are being sacked.

A poet and social commentator, Mr. Odia Ofeinum, said government budgets in the country had been riddled by corruption.

He said, “Most of the budgets we have had in the Fourth Republic have 60 per cent of waste and corruption. You can remove 60 per cent of the budgets and throw it away and they would not have done lesser than they have done, which tells you that the level of waste in the system accounts for the hogwash we have called budgets.”

He, however, said it would be difficult for Nigeria to get out of this situation “with corrupt persons dictating the affairs of political parties.”

Biafra: 6 IPOB Members Shot Dead In Aba, 30 Injured, 45 In Police Net - Vanguard

ABA—The protest embarked on by the Indigenous People of Biafra, IPOB, over the prolonged detention of their leader, Nnamdi Kanu, yesterday, turned bloody in Aba, Abia State, as a combined team of security agents, comprising soldiers and policemen allegedly fired shots at the protesters, killing six members of the group and arresting 20.

Also in Enugu, the Police in the state yesterday, arrested 25 members of the IPOB, who had gathered at the Naira Triangle in preparation for a protest march. Vanguard gathered that the protesters had, as early as 9am, converged at National High School, along Port Harcourt-Aba road, from where they usually march to other areas of the city when security agents swooped on them.

Sources said the IPOB members were in prayer session when the soldiers and their police counterparts invaded the area and arrested some leaders of the group. In the confusion, several protesters were injured while 10 were feared dead.

Eyewitnesses told Vanguard that the casualty figure would have been higher had some of the protesters not escaped. According to them,“the protesters as usual, gathered at the school to pray before taking off, but soldiers and policemen invade the area.

There was heavy shooting. I saw more than three dead people. Many others were injured.” The situation caused tension in the area as shop owners and residents scampered to safety.

Motorists avoided the stretch between Crystal Park Hotel junction and National High School in order not to be caught in the crossfire. An IPOB official who spoke on the condition of anonymity said the security agents arrested the group’s Aba Coordinator identified as Ikechukwu and some of his assistants.

The official, who disclosed that 20 IPOB members were being detained by the Police, insisted that they would not relent until their detained leader is released as well as the actualization of an independent state of Biafra, adding that the protest would continue until Friday.

At the time of filing this report, over 30 members of the group were reportedly receiving attention at various hospitals in the city. When Vanguard visited the area, stern looking soldiers and policemen were seen at strategic positions while a convoy over 30 patrol vans later took the arrested protesters away. Contacted on phone, spokesman of the Abia State Police command, DSP Ezekiel Onyeke, told Vanguard that he was yet to be briefed on the incident.

Enugu protest The protest march which they had tagged “mother of all protest marches” was nipped in the bud by security agents who stormed the venue where they were trooping in numbers. The Naira Triangle was almost covered with a sea of heads when the security operatives struck and dispersed them.
Canisters of tear gas were shot at the gathering which snowballed into physical show of strength between the IPOB members and security agents. But for the application of extreme professional caution by the security agents, the fracas could have resulted in many loss of lives.

Although many of the IPOB members sustained injuries, many took to their heels as the police released shots of tear gas into the crowd. The media and publicity officer of IPOB, Emma Powerful decried the attitude of the security agents towards its members, saying the group is not a violent group and were assembling for a peaceful protest march.

Groups condemn killings Detained leader of Indigenous People of Biafra.

Civil society organizations in Abia State under the auspices of Abia Human Rights Agenda yesterday condemned what it described as the killing of defenceless protesters in Aba.
The group called on the Chief of Army Staff, Major General Tukur Buratai and the Inspector General of Police, Mr. Solomon Arase to cause investigation into the dastardly acts and prosecute those found culpable, to serve as a deterrent to others.

Addressing newsmen in Aba, the group; Foundation for Environmental Rights and Advocacy, FENRAD; Society for Economic Rights and Social Justice, SERSJ; Human Rights, Justice and Peace Foundation, HRJPF; among others; contended that over 15 persons have lost their lives in pro-Biafra protests in the city, describing the situation as unacceptable and called on security agents to respect the rules of their engagements.

Spokesmen for the groups, Nelson Nwafor, Innocent Nwokocha, and Cassius Ukwugbe, described the killings as the height of human rights violations by those who are paid to protect lives and properties, asserting that the killing of unarmed citizens is a heinous crime against God and humanity.

According to the CSOs, “Over 10 people lost their lives during the protest against the detention of the Director of Radio Biafra, Nnamdi Kanu. Several others sustained various degrees of injuries as security agents clashed with protesters. Security agents must restrict themselves to the rules of their engagements in crisis situation.”

DSS Foils Attempt To Hack & Steal N4.5b From Treasury Single Account

The Department of State Services (DSS) has said that the service had foiled a plan by a group of fraudsters to steal N4.5 billion from the Treasury Single Account (TSA) by hacking the Government Integrated Financial Management Information System (GIFMIS).

This is contained in a statement issued by an official of the service, Mr Tony Opuiyo, Yesterday in Abuja.

According to Opuiyo, between December 2015 and February, 2016, the Service also busted the network of syndicated kidnap gangs in different regions in the country which includes Kebbi, Zamfara, Niger, Nasarawa, FCT, Oyo and Osun states.

The statement also said that the service had arrested a suspected recruiter for the Islamic State of Iraq and Syria on Jan. 17 in Kano. The arrest was sequel to available intelligence which indicated the suspect’s terrorist antecedents and covert drive to indoctrinate and recruit susceptible youths in the country.

Saraki: Senate President Could Face 14-year Jail Term, Ban from Public Office If Convicted

With the collapse of the fierce battle at the Supreme Court on Friday to stave off his trial by the Code of Conduct Tribunal (CCT) for allegedly falsifying his declaration of his assets, Senate President, Bukola Saraki, on conviction risks 14 years jail term, losing his position, 10 years ban form holding public and forfeiture of any asset related to the alleged offence.

The Code of Conduct Bureau and Tribunal Act empowers the Code of Conduct Tribunal to impose any of the punishments prescribed in section 23 of the act.
Section 23 of the Code of Conduct Bureau and Tribunal Act provides: “(1) Where the tribunal finds a public officer guilty of contravening any of the provisions of this act, it shall impose upon that officer any of the punishments specified under subsection (2) of this section.”

Section 23(2), however, states: “The punishment which the tribunal shall impose shall include any of the following: (a) vacation of office or any elective or nominated office as the case may be; (b) disqualification from holding any public office (whether elective or not) for a period not exceeding 10 years; (c) seizure and forfeiture to the state of any property acquired in abuse or corruption of office.”
The prescribed sanctions are also provided for in paragraph 18 of Part 1 of the Fifth Schedule to the 1999 Constitution (as amended).

However, to show that the prescribed sanctions may not be exhaustive, as the Act employs the word “include,” section 23(3) of the Code of Conduct Bureau and Tribunal Act provides: “The punishments mentioned in subsection (2) of this section shall be without prejudice to the penalties that may be imposed by any law, where the breach of conduct is also a criminal offence under the Criminal Code or nay other enactment or law.”

Under this provision, if found guilty of breach of the Code of Conduct for Public Officers, Saraki may also be punished for perjury, as his asset declaration was done under oath. The Criminal Code Act prescribes imposition of 14 years jail for perjury.

Section 118 of the Criminal Code Act states: “Any person who commits perjury is liable to imprisonment for 14 years. If the offender commits the offence in order to procure the conviction of another person for an offence punishable with death or with imprisonment for life he is liable to imprisonment for life.”
But whether a false declaration on oath amounts to perjury depends on the interpretation accorded the provisions of the law creating the offence.

What amounts to perjury is defined in section 117 of the Criminal Code Act. The section states: “Any person who, in any judicial proceeding, or for the purpose of instituting any judicial proceeding, knowingly gives false testimony touching any matter which is material to any question then pending in that proceedings, or intended to be raised in that proceeding, is guilty of an offence which is called perjury.”

Shedding light on the offence, Mr. Sebastine Hon (SAN) said what constitutes perjury depends on the law creating the crime. Whether merely falsely swearing to an oath amounts to perjury, he said, depends on the law creating it.
Chief Mike Ozekhome (SAN) also agreed that perjury depends on the provisions of the law creating it.

He, however, said merely falsely swearing to an oath, including false declaration of assets, cannot amount to perjury under section 117 of the Criminal Code Act.

For a false declaration on oath to amount to perjury under the section, he explained, the deponent must have done so in a judicial proceeding or intended such declaration on oath to be used in a judicial proceeding.

Fayose To Buhari: 'Withdraw 2016 Budget, It’s A National Embarrassment'

VangaurdNgr: Governor Ayodele Fayose of Ekiti State has urged President Muhammadu Buhari to save the country of the national embarrassment being caused by the 2016 Budget that he presented to the National Assembly by formally withdrawing the budget and re-presenting it.

According to a statement issued on Tuesday, by his Special Assistant on Pubic Communications and New Media, Lere Olayinka, the governor said “the President should admit that there were avoidable errors in the budget and since he is human and not immune to errors, he should simply do the needful by presenting a new and credible budget to the National Assembly.”

Buhari-FayoseGovernor Fayose described revelation by the Health Minister, Prof. Isaac Adewole, that the proposal drawn up by the ministry and submitted to the budget office had been doctored and that “foreign” appropriations, different from what was submitted, had been sneaked in,as the height of national embarrassment.

While addressing the Senate Committee on Health during its budget defence session on Monday, Prof Adewole had stunned the Senators when he said;
“We have to look into the details of the budget and re-submit it to the committee. This was not what we submitted. We’ll submit another one. We don’t want anything foreign to creep into that budget. What we submitted is not there.”

The minister went further to say that in the revised budget as re-submitted, N15.7 billion for capital allocation was moved to other areas and that there was nothing allocated to public health and family health.

In his reaction, Governor Fayose said: “Last week, we were told that the Senate discovered a sum of N10 billion questionably smuggled into the budget of the Ministry of Education for an allegedly questionable subhead.

“Also, we were told of the existence of a budget mafia in the Presidency that was said to be responsible for the embarrassing allocations in the Budget.

“Before now, we were told that a totally N3.87 billion was allocated for capital projects at the State House Clinic alone, over N700 million more than capital allocation to all the 16 federal teaching hospitals combined.

“Now, a whole minister has come out to say that budgetary provision for his ministry was forged!

“If under a President that says he is fighting corruption, the budget of the country got missing and we are now being told that the budget being considered by the National Assembly has been forged, one cannot but be afraid that there is possibility of Nigeria being forged one day, after the original must have gone missing.”

A 30-year-old corps member and housewife, Funmilayo (pseudonym) has been battered by her husband, identified only as Bade, who also allegedly poked his finger into her eye during a disagreement at their home in the Surulere area of Lagos State.

Bade was also alleged to have stabbed her in the face with a broken glass and rained blows into her head and face.

She was rushed to a health centre in the area before being taken to the Lagos State University Teaching Hospital, Ikeja.

Policemen from the Surulere division were said to have arrested and detained Bade, after which he was released on bail.

PUNCH Metro learnt that the drama happened last Monday at the couple’s residence in the Kilo area of Surulere.

Funmilayo, an Insurance graduate, said she had followed her husband to his parent’s house on the day, and they had returned around 8pm.

She said, “Immediately we got home, he said he wanted to go for a meeting somewhere and I told him to return as early as possible before they shut the street gate at 10pm.

“When it was 11pm, I called him, but he didn’t pick his calls. He also did not respond to a Whatsapp message I sent around that time. He later picked his call and I warned him that if he returned too late I would not rise up from bed to open the gate for him.

“Around 1am, I called his telephone line again and I heard a noise at the background. I overheard a lady talking. I told him I was going for my NYSC Community Development Service early in the morning, but he ignored me.”

Funmilayo, who already had two children for Bade, said she returned to bed, but her husband did not return until it was 2am.

“At about 2am, he called me on the telephone and said I should come and open the gate, but I ignored him. When I eventually went downstairs to open the gate, somebody else had done it.

“He abused my mother and I cautioned him, but he said it was my day of reckoning and my cup of iniquity was full. I was in my night gown that time.

“He picked up his belt and started beating me. As I tried to run away from him, I fell down. During the struggle, a mirror fell on the floor and he stabbed me with a splinter. He sat on me. I screamed in pain and shouted for help, but nobody came to my rescue.

“He poked a finger into my eye and gave me several blows in the face,” she said.
Funmilayo explained that she managed to bite Bade’s leg, adding that it was then he let go of her.

She said an in-law rushed her to a medical facility in the area before she was later taken to LASUTH for treatment.

The case was said to have been reported at the Surulere Police Station, leading to the arrest of the suspect.

However, PUNCH Metro gathered that after the detention of the suspect, some family members prevailed on the victim to let go of the case “because of the children.”

The couple were, however, said to have separated pending when the matter would be fully resolved.

When contacted, Bade denied attacking his wife, adding that she was the first to assault him.

“All she said was a lie. It was my hand that I used to beat her and she was the one that used a plank to hit me in the back and even stabbed me with the broken mirror.

“I have a deep cut in my back and in the front. I slapped her.
“She got a swollen face because she is plump,” he said.

The Police Public Relations Officer, SP Dolapo Badmos, said the police were preparing to take Bade to court when his wife came to withdraw the case.

She said, “A case of assault occasioning harm was reported against the man.

“He was arrested, detained and given bail to a reliable surety and warned to report back the next day during which the charges were ready.

“But the wife (victim) came back and was pleading, along with both families, not to take the case to court on the grounds that he is her husband and the father of her children.

“However, undertaking was written by the husband to be of good behaviour. The case is sitll on.

Dangote Slashes Cement Price Again!

Giant cement manufacturer, Dangote cement has slashed the price of its cement varieties as a result of its economy of scale occasioned by the recent introduction of new production lines in Okpella Edo State and Itori in Ogun State worth nine million metric tonnes,

The company, in a statement, stated that the price cut from N1800 to N1300 was to ensure the product is affordable to all segment of users.

In the same light the company has gone a step further to train block moulders on the right mix to get quality blocks.

Speaking in Umahia, the Abia State capital during a national meeting of the National Association of Block Moulders of Nigeria (NABMON), Regional Sales Director, Dangote Cement, Johnson Olaniyi, stated that Dangote Cement considered incessant building collapse as an indictment on all sector operators hence his company’s resolve to continue the collaboration with all so as to tackle the menace.

While assuring that Dangote Cement would continue to ensure that block moulders have access to its quality cement as part of its contribution to the war against building collapse, the Sales Director further stated that the company reduced the price of its cement from N1800- N1300 to enable Nigerians have unhindered access to the product.

FG To Cut N1.84tn Borrowing Through Treasury Single Account Recovery

The Federal Government is planning to reduce the amount of borrowing needed to fund the 2016 budget from funds mopped up from government agencies through the implementation of the Treasury Single Account.

The 2016 budget, which has been submitted by President Muhammadu Bubari to the National Assembly, has a deficit of N2.2tn.

The deficit, according to the fiscal document, is to be financed through the borrowing of N1.84tn made up of domestic borrowing of N984bn and foreign borrowing of N900bn.

There are anxiety in government circles that the deficit may rise to about N3tn as a result of the global drop in oil price, which is currently selling below the $38 per barrel budget benchmark price.

But speaking on Monday at a workshop on TSA for the accountants-general of the states in Abuja, the Minister of Finance, Mrs. Kemi Adeosun, said the over N2.2tn, which has so far been recovered from government agencies through the TSA, would assist in reducing the volume of borrowing.

She said the current issues and challenges surrounding cash flow management had re-enforced the need to ensure that scarce resources at the disposal of the federal, state and local governments were prudently and efficiently managed.

Adeosun described the workshop as apt and timely, as it came at a time when the global economic downturn was creating challenges that demanded efficient and effective management of cash resources.

She explained that the TSA was an essential reform for any government wishing to pursue fiscal sustainability and prudent management of its resources.

Outlining some of the benefits of the TSA, the minister said it would increase accountability and transparency, improve the processing of payments and collections, and reduce borrowing costs.

Adeosun said, “The global economic challenges, which are affecting our nation, demand optimum efficiency in the management of public funds. These objectives require an overhaul of the financial management approaches adopted to meet financial obligations on time and ensure that cost effective financial support is provided to public institutions.”

''How Metuh Used Part Of Dasuki’s N400m To Buy Landed Property In Lagos'' - Witness

A prosecuting witness, Junaid Sa’ad on Tuesday told the Federal High Court sitting in Abuja that the spokesman of the Peoples Democratic Party,PDP, Chief Olisa Metuh took N50m out of the N400m given to him by former National Security Adviser, NSA, Col Sambo Dasuki,(rtd) to purchase landed property in Lagos.

Sa’id, a detective at the Economic and Financial Crimes Commission (EFCC),is the eight witness to have have testified against Metuh.

Testifying before Justice Okon Abang, Sa’id, said the embattled PDP spokesman used part of the slush funds, about N500m, received from the office of national security adviser (ONSA) to buy property at Banana Island, Lagos.

He said, “Investigation revealed that after the payment of N400m by ONSA, a total sum of N366m was paid into the same account by one Kabiru Ibrahim, who also paid in N150m; Capital Field Investment Limited paid in N91m, and one Eyitonye, paid in N82m,”

“These funds formed the naira equivalent of $2m, which the first defendant [Metuh] gave to one Nneka Ararume in cash.

“Investigations revealed that all this money was used for PDP campaign activities and for personal use by the first defendant. The money used for PDP campaign activities were from the sum of N400m. Among the disbursement made, the sum of N77.5m was paid to CMC connect for campaign activities; the sum of N25m was paid to Abba Dabo for campaign activities; and the sum of N21.7m was paid to Chief Tony Anenih. Another sum of N5m was discovered to have been paid to Chief Kema Chikwe, and the sum of N50m was found to have been transferred to a joint account of the first defendant and his wife.

“The sum of N500m was also discovered to have been transferred to Daniel Ford International Limited in two tranches of N200m and N300m for the purpose of buying landed property at Banana Island, Lagos, by Metuh.

“In the course of the investigation, the team visited the residence of the first defendant and invited him to the commission. He was interviewed. After the interview, he was asked if he was willing to volunteer a statement in writing. He said, ‘yes’. When he concluded writing his statement, which was in four sheets, he handed them over to us. I read what he had written. I also gave it to my other team members to read. After that, I returned it to him for endorsement.

“He endorsed the first sheet, he endorsed the second sheet; when he was to endorse the third sheet in which he had stated that the money he received from ONSA was used for PDP campaign activities to settle his personal debts, to the surprise of the team he suddenly tore the sheet. The pieces of the torn sheets were then recovered from him and registered as exhibit.”

Adamawa Governor Increases Corpers' Allowance From N2,000 To N10,000

Governor Jibrilla Bindow of Adamawa State on Monday increased the N2,000 monthly stipends for each National Youth Service Corps members serving in the state to N10,000.

Bindow announced this while receiving the management team of the NYSC, who paid him a courtesy call at the Government House in Yola.
He said:

“I feel it most expedient to review the N2,000 monthly stipend of corps members serving in this state to N10,000.”
Bindow said the gesture was in appreciation and recognition of the socio-economic contributions of the NYSC to the development of the state.

He said his government had also approved fund for the purchase of 36-seater bus for the NYSC.

He said: “We find it necessary, due to the present economic situation of our people, and as you all know the APC represents change.
“We will continue to provide welfare and social security to mankind as one of the cardinal visions of our great party.”
Bindow also approved the relocation of Internally Displaced Persons from the state NYSC orientation camp in Damare to Malkohi for the corps members to resume orientation in the state.

He said he would collaborate with the NYSC and security agencies to ensure that the next batch of corps members were hosted in the state.
The State Coordinator of the NYSC, Umaru Jauro, lauded the governor for his support.
Jauro said he was directed to get in touch with Bindow on the security situation for corps members to resume orientation in the state.
